Terms of Service

1. Agreement and eligibility
These Terms of Service ("Terms") are a binding agreement between SOLAR CODE SRL, registered at str. Republicii 33, MD-3909 Cahul, Republic of Moldova, company registration number 1024603002594 ("Attributely", "we", "us"), and the person or entity creating an Attributely account ("you", the "customer"). By creating an account or using the service, you accept these Terms.
Attributely is a business-to-business service. You must be at least 18 years old (or the age of legal majority in your jurisdiction) and use the service for business purposes. If you accept these Terms on behalf of a company, you represent that you are authorized to bind it. These Terms are effective as of June 12, 2026.
2. The service
Attributely is a marketing-attribution service for lead-generation and ecommerce websites. You embed a first-party JavaScript snippet on websites you own or control, and Attributely:
- Tracks anonymous visitor sessions, pageviews, and traffic sources (UTM parameters, referrers, Google Ads
gclidclick IDs). - Captures leads when a visitor submits a form and ties each lead back to its full multi-visit journey using first-touch and last-touch attribution models.
- Captures ecommerce purchases via the GA4/GTM dataLayer or an explicit
Attributely.trackPurchase()call. - Provides inbound phone-call tracking through rented tracked numbers (provisioned via Twilio) that forward to your real business line, with call recording, transcription, and attribution. There is no outbound dialer.
- Optionally uploads captured conversions to Google Ads (offline conversion import keyed on
gclid) if you connect your Google Ads account.
The service does not include CRM integrations or syncs, offline conversion imports other than Google Ads, outbound calling, or third-party cookies. Attributely never sells personal data or shares it for advertising.
3. Accounts and workspaces
You are responsible for keeping your account credentials secure and for all activity under your account. Subscriptions are held per owning user, with usage pooled across all workspaces that user owns; invited team members never hold their own subscription. Plan limits apply to workspaces (1/3/5/unlimited by plan) and websites (an account-wide pool of 3/15/50/unlimited); seats are unlimited on all tiers.
4. Free trial
New accounts receive a 14-day free trial on Growth-level lead terms, with no card required. During the trial, overage is hard-capped at $0 and phone tracking is disabled. When a trial expires without conversion to a paid plan, the account becomes read-only/expired.
5. Plans, billing, and overage
Plans and pricing
Plans are Starter ($59/mo), Growth ($119/mo), Business ($249/mo), and Enterprise (contact us). Yearly billing is available at 10× the monthly price (2 months free). All prices are in USD. Plans are billed monthly, or annually at ten times the monthly rate (about two months free); usage-based overage and extra-number fees are always billed monthly.
What counts as usage
A "lead" is a form submission or an attributed inbound call. Monthly allotments per plan: leads 500 / 1,200 / 3,000; ecommerce purchases 500 / 1,200 / 3,000. Phone usage is covered by a monthly call credit ($30 / $60 / $125) — a dollar balance that pays for number rental and call minutes at published US/CA rates (local numbers from $2.50–$3.00/mo; minutes from $0.05–$0.06/min depending on tier; toll-free slightly higher), with recording and transcription included.
Metered overage
Past your allotment, capture continues and is billed per unit: leads at $0.08 / $0.06 / $0.05 per plan. The call credit resets monthly; optional credit top-ups ($20 / $50 / $100) are billed when purchased and do not expire.
Overage spend cap
Every account owner can set a monthly overage budget. The default for paid accounts equals the plan base price; a $0 cap means a hard stop at the allotment. When the cap is reached, new billable captures are rejected (HTTP 402), but session tracking and your existing data are unaffected — nothing is deleted.
Pageview soft cap and rate limiting
Pageview soft caps (100k / 600k / 1.5M / unlimited) never bill and never block attribution; they only shed excess pageview storage. Per-IP and per-site rate limiting protects the service.
Billing processor
Billing (checkout, billing portal, invoices, webhooks) is handled by Stripe. Attributely never stores card numbers.
6. Cancellation and refunds
You can cancel at any time via the Stripe billing portal. Cancellation takes effect at the end of the current paid period, and the service continues until then. Refund policy: fees already paid are non-refundable.
7. Your responsibilities as a customer
Consent and disclosure on your own sites
You are solely responsible for any cookie banner or consent capture required in your jurisdiction. This is mandatory for Advanced tracking mode (which uses device fingerprinting and persistent storage) and for ecommerce buyer-contact capture, and recommended generally for both tracking modes. You must disclose Attributely as a processor in your own privacy policy.
Call-recording compliance
You are the data controller for call recordings. Attributely always plays a pre-call disclaimer to callers (customizable per number), but you must ensure your disclaimer text, consent regime (for example, two-party-consent US states, Germany, France), and any industry rules (healthcare, financial services) are satisfied. Telephony numbers may require regulatory bundles in some countries; provisioning can be rejected or delayed by regulators.
Data-subject requests
Erasure and access requests from your visitors and callers go to you as the controller. Attributely will assist, including a documented erasure workflow for callers.
Lawful use only
- Only track websites you own or control; the script's allowed-origin check enforces the registered domain.
- No unlawful surveillance of any kind.
- No attempts to capture payment-card data — the script actively scrubs it.
- Raw-IP exports may only be used for ad-platform exclusion lists, not for any other purpose.
8. Acceptable use
- No circumvention of metering, rate limits, or bot filters.
- No reverse engineering of the service or the tracking script.
- No reselling of the service without an agency arrangement. Marketing agencies may manage workspaces and websites for their clients under their own subscription; any other resale requires our prior written agreement.
We may suspend or terminate accounts that violate this section or section 7.
9. Data processing
For personal data of your website visitors and callers, you are the controller and Attributely is your processor. Our processing of that data is governed by our Data Processing Agreement, which is incorporated into these Terms by reference and includes our subprocessor list (see the Privacy Policy). 10. Accuracy and availability disclaimers
Attribution, bot classification, AI conversion verification, call transcription, and AI call summaries are best-effort and probabilistic. We make no guarantee of capture completeness: ad blockers, consent refusal, cross-device journeys, and similar factors can cause gaps in the data.
No service-level agreement (SLA) applies to the Starter, Growth, or Business plans. Enterprise plans may include a custom SLA agreed in writing.
11. Warranty disclaimer
The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Attributely's total aggregate liability under these Terms is capped at the fees paid by you in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Changes to the service
Features — including the Google Ads upload, tracked numbers, and pricing of metered units — can change with notice. We will give 30 days' notice before price changes take effect.
14. Termination
You may stop using the service and cancel at any time (section 6). We may suspend or terminate your account for material breach of these Terms, including violations of sections 7 and 8, or for non-payment. On account closure, your data is deleted per the schedule in the Privacy Policy. All customer data is deleted within 30 days of account closure, and from backups within 90 days.
15. Governing law
These Terms are governed by the laws of the Republic of Moldova, and any disputes will be resolved in the courts of the Republic of Moldova.
16. Changes to these terms
We may update these Terms as the service evolves. We will post the new version on this page, update the "Last updated" date, and notify account owners by email of material changes before they take effect.
